PLEASE READ THESE TERMS AND CONDITIONS COMPLETELY AND CAREFULLY BEFORE ACCEPTING. THESE TERMS HAVE LEGAL CONSEQUENCES AND WILL AFFECT YOUR LEGAL RIGHTS AND ABILITY TO BRING FUTURE LEGAL ACTIONS. THESE TERMS INCLUDE A DISPUTE RESOLUTION SECTION (INCLUDING AN ARBITRATION AGREEMENT, CLASS ACTION WAIVER, AND JURY TRIAL WAIVER).
BY CLICKING "I AGREE", THE BEARER (AND/OR PURCHASER) OF TICKETS TO THE 2025 RYDER CUP (“BEARER''), ANY INDIVIDUAL SEEKING ENTRY TO THE 2025 RYDER CUP THROUGH THE USE OF A TICKET ISSUED TO OR HELD BY BEARER (INCLUDING BUT NOT LIMITED TO MINORS AND ALL OTHER ATTENDEES), AND ALL OTHER PERSONS ACTING OR PURPORTING TO ACT ON BEHALF OF ANYONE GAINING ADMISSION TO THE 2025 RYDER CUP (EACH OF THE FOREGOING, INCLUDING THE BEARER, HEREINAFTER A "HOLDER" OR "YOU"), AGREE THAT (i) SUCH LICENSE IS SUBJECT TO THESE TERMS & CONDITIONS (“AGREEMENT”), AND (ii) BY PURCHASE, ACCEPTANCE AND/OR USE OF SUCH LICENSE, EACH HOLDER IS DEEMED TO HAVE READ AND UNDERSTOOD THIS AGREEMENT, AND AGREED TO BE BOUND BY IT ON BEHALF OF THEMSELF AND ALL OTHERS WHO GAIN ENTRY TO THE 2025 RYDER CUP (INCLUDING PARKING AREAS OR ENTRY GATES) USING TICKETS ISSUED TO, PROVIDED TO, OR OTHERWISE USED TO GAIN ADMISSION FOR THE HOLDER. BEARER REPRESENTS AND WARRANTS THAT EACH PERSON WHO ENTERS THE 2025 RYDER CUP GROUNDS THROUGH TICKETS PURCHASED BY, ISSUED TO, PROVIDED TO, OR HELD BY BEARER HAS AUTHORIZED BEARER TO ACT ON THEIR BEHALF FOR PURPOSES OF AGREEING TO THIS AGREEMENT.
1. All admission tickets issued by the PGA of America (“PGA”) granting access to the 2025 Ryder Cup (the “Event”) are licenses that may be revoked by the PGA or the PGA Tournament Corporation, Inc. (“PTC”) in their sole discretion for any reason or no reason at all. Subject to the terms below, Holder’s sole remedy in the event the PGA or PTC revokes your ticket of admission for the Event without cause shall be a refund of the amount of the purchase price of the ticket paid to the PGA/PTC, less any applicable taxes and fees. PTC is the collection agent for Patina Golf Tour Events, LLC (“Patina”), a third-party provider of concession services selected by PTC, with respect to the Ryder Cup+ Inclusive Food and Non-Alcoholic Beverage Program at the Event described below in Paragraph 14. As described below in Paragraph 15, a portion of the price of all applicable admission tickets are allocated to those Ryder Cup+ Inclusive Food and Non-Alcoholic Beverage Program services.
2. ARBITRATION; JURY TRIAL WAIVER; CLASS ACTION WAIVER; CHOICE OF LAW. TEXAS LAW, WITHOUT REGARD TO CONFLICT OF LAW PRINCIPLES, GOVERNS THE INTERPRETATION OF THIS AGREEMENT AND ANY CONTROVERSY OR CLAIM ARISING OUT OF OR IN ANY WAY RELATING TO THIS AGREEMENT, OR BREACH THEREOF, INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE CLAIMS OR OTHER TORT CLAIMS OF ANY KIND, STATUTORY CLAIMS OF ANY KIND OR ANY OTHER CLAIMS FOR RELIEF UNDER ANY OTHER LEGAL THEORIES.
EXCEPT AS EXPRESSLY PROVIDED HEREIN, ANY DISPUTE BETWEEN HOLDER, ON THE ONE HAND, AND THE PGA, PTC, OR PATINA (HEREINAFTER “MANAGEMENT”), ON THE OTHER HAND, IN ANY WAY RELATING TO OR ARISING FROM THIS AGREEMENT, OR ENTRY INTO THE EVENT, PARKING AREAS, AND/OR ENTRY GATES BY HOLDER, WHETHER BASED IN CONTRACT, TORT, STATUTE, FRAUD, MISREPRESENTATION, OR ANY OTHER LEGAL THEORY (HEREINAFTER A “DISPUTE”), SHALL BE RESOLVED BY BINDING ARBITRATION ADMINISTERED BY JAMS WITH A PANEL OF THREE (3) ARBITRATORS UNDER ITS COMPREHENSIVE ARBITRATION RULES AND PROCEDURES, AND JUDGMENT ON THE AWARD RENDERED BY THE ARBITRATOR MAY BE ENTERED IN ANY COURT HAVING JURISDICTION THEREOF. SUCH ARBITRATION SHALL ADHERE TO JAMS’ MINIMUM STANDARDS FOR ARBITRATION PROCEDURES, REMAIN CONFIDENTIAL, AND BE HELD IN DALLAS, TEXAS.
BEFORE INITIATING ANY ARBITRATION PROCEEDING, A WRITTEN "NOTICE OF DISPUTE" MUST CONTAIN THE FOLLOWING INFORMATION: (I) INFORMATION SUFFICIENT TO IDENTIFY ANY TRANSACTION, ACTIVITY, OR OCCURRENCE AT ISSUE; (II) CONTACT INFORMATION (INCLUDING NAME, ADDRESS, TELEPHONE NUMBER, AND EMAIL ADDRESS); AND (III) A DETAILED DESCRIPTION OF THE NATURE AND BASIS OF THE DISPUTE (INCLUDING THE DATE OF ANY TRANSACTION, ACTIVITY, OR OCCURRENCE AT ISSUE) AND THE RELIEF SOUGHT, INCLUDING A CALCULATION FOR IT. THE NOTICE MUST BE PERSONALLY SIGNED BY HOLDER (AND THEIR COUNSEL, IF REPRESENTED). IF HOLDER HAS A DISPUTE, THEY SHALL SEND A COMPLETED NOTICE OF DISPUTE BY EMAIL TO TICKETING@PGAHQ.COM. HOLDER AND MANAGEMENT AGREE TO MAKE A GOOD FAITH EFFORT TO RESOLVE ANY DISPUTE FOR AT LEAST 60 DAYS FOLLOWING RECEIPT OF A COMPLETED NOTICE OF DISPUTE. THIS IS A CONDITION PRECEDENT TO ARBITRATION. ALL APPLICABLE LIMITATIONS PERIODS (INCLUDING STATUTES OF LIMITATIONS) WILL BE TOLLED FROM THE DATE OF RECEIPT OF A COMPLETED NOTICE OF DISPUTE THROUGH THE CONCLUSION OF THIS PROCESS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PARTIES WAIVE ANY RIGHT TO A JURY TRIAL AS TO ANY CLAIM OR DISPUTE.
EACH PARTY AGREES THAT THEY WILL RESOLVE ALL DISPUTES ON AN INDIVIDUAL BASIS. THE PARTIES WAIVE ANY RIGHT TO ASSERT ANY DISPUTE AGAINST ANY OTHER PARTY AS A REPRESENTATIVE OR MEMBER IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION, WHETHER DURING BINDING ARBITRATION, OR LITIGATION, EXCEPT WHERE SUCH WAIVER IS PROHIBITED BY LAW OR DEEMED BY A COURT OF COMPETENT JURISDICTION CONSTRUING THIS AGREEMENT TO BE UNENFORCEABLE. HOLDER HEREBY AGREES TO WAIVE ANY RIGHTS TO PARTICIPATE IN, AND AGREES NOT TO PARTICIPATE IN, ANY CLASS ACTION, REPRESENTATIVE ACTION, CLASS ARBITRATION, CONSOLIDATED ARBITRATION OR COURT PROCEEDING, OR ANY SIMILAR PROCEEDING, WITH RESPECT TO ALL CLAIMS HEREUNDER.
THE PREVAILING PARTY IN ANY PROCEEDING RELATING TO OR ARISING FROM HOLDER’S ENTRY INTO THE EVENT, PARKING AREAS, AND/OR ENTRY GATES AREAS SHALL BE ENTITLED TO RECOVER ITS ATTORNEYS’ FEES AND COSTS, INCLUDING THE COSTS OF ARBITRATION, FROM THE OTHER PARTY TO THE FULLEST EXTENT PERMITTED BY LAW.
IF HOLDER DOES NOT CONSENT TO THESE DISPUTE RESOLUTION PROVISIONS, HOLDER MUST LEAVE OR NOT ENTER THE EVENT (INCLUDING PARKING AREAS AND/OR ENTRY GATES).
3. Holder shall carry, and where possible display, their ticket at all times during the Event.
4. For security or other purposes consistent with the license granted by ticket of admission, Holder consents to the reasonable inspection of his/her person and property before entering and/or during the Event.
5. Holder ASSUMES ALL RISKS, hazards, and dangers arising from or relating to Holder’s attendance at the Event and related activities, from all known and unknown causes and obvious and hidden conditions, including, but not limited to, personal injury (including death), which includes, without limitation, injuries resulting from being struck by misdirected golf balls and/or falls on the course and surrounding areas, sickness (including illness and other risks of exposure to COVID-19, or any other communicable disease or illness, or a bacteria, virus or other pathogen capable of causing a communicable disease or illness); and Holder RELEASES, WAIVES, AND COVENANTS NOT TO SUE the PGA, PTC, Patina, State of New York, Bethpage State Park, participating players and each of their respective Officers, Directors, Employees, Agents, Members and Affiliates from any and all liabilities from any such cause.
6. You acknowledge that COVID-19 is extremely contagious and that despite the measures the Event has implemented to help mitigate the risk of transmission, the elimination of risk of exposure and infection to COVID-19 is not currently possible.
7. Holder grants PGA, PTC and any of their authorized third parties the irrevocable, transferable, perpetual right and license to use their name, voice, image and likeness recorded or captured in connection with the Event for any purpose and in any medium (whether now known or hereafter created).
8. Holder agrees not to capture, collect, transmit, distribute, publish, or sell any account, description, reproduction, video (live or recorded), audio, photograph, scoring-related data or statistic of, from or at the Event on any day of the Event throughout the Event site, including any practice round (“Event Content”), for any purpose except as expressly permitted in this Agreement. PGA is the sole owner of, and Holder assigns to PGA, all right, title and interest in and to all Event Content, including all copyrights and rights to use all Event Content, subject to permission from PGA to capture and distribute certain Event Content on the limited terms set forth in this Agreement.
9. Holder may capture video, audio, and photographs at the Event on any day of the Event throughout the Event site (including, for clarity, competition areas on competition days), consistent with all posted rules and instructions of the PGA and/or Event Marshals and Officials. Holder may not use such video, audio, and photographs for commercial purposes and may not distribute such content on a live or near-live basis (i.e., no live streaming) or use such content to create a real-time, stroke-by-stroke or hole-by-hole account of the Event. Further, Holder shall not use or authorize others to use any such content or other Event Content for any commercial or promotional purpose, or for or in connection with a media outlet (directly or indirectly) unless the Holder and the media outlet have received official media credentials for the Event from PGA.
10. Upon reasonable request by PGA, at PGA’s cost and expense, Holder will sign any documents necessary to effect PGA’s ownership of all Event Content.
11. For the avoidance of doubt and without limiting the foregoing, Holder agrees not to capture, collect, transmit, distribute, publish, or sell any Event Content (including any scoring, statistical, competition or other data at or from the Event) for purposes of any betting or gambling-related activity.
12. Holder agrees to follow the guidelines of Golf Mode while onsite. Adhering to Golf Mode includes mobile devices set to silent or vibrate, including but not limited to ringer and notifications/alerts, and camera flash turned off.
13. You acknowledge that Event tickets shall be for the exclusive use of you and your guests. You acknowledge that repackaging of tickets without prior written consent of the PGA is expressly prohibited, inclusive of but not limited to including tickets in travel and/or hospitality packages or sweepstakes or commercial promotion. You and all ticket holders agree to adhere to any other rules, guidelines, or codes of conduct established by PGA or PTC in advance of, or at, the Event.
14. Ryder Cup+ Inclusive Food & Non-Alcoholic Beverage Program
If this ticket is a Ryder Cup+ Inclusive Food & Non-Alcoholic Beverage Program ticket, Holder of this ticket at the Event is entitled to participate in the Ryder Cup+ Inclusive Food & Non-Alcoholic Beverage Program, which consists of food and non-alcoholic beverages offered by Patina at concession stands or concession markets made available to the general admission ticket holders. Private hospitality areas or clubs, as well as the clubhouse and other areas in which admission is limited, are specifically excluded from access provided to a Holder of a Ryder Cup+ Inclusive Food and Non-Alcoholic Beverage Program ticket. Ryder Cup+ Inclusive Food & Non-Alcoholic Beverage Program ticket Holders are limited to a quantity of food and non-alcoholic beverages that can be ordered per visit to a concession stand or concession markets. Each Holder shall be entitled to order one (1) entrée, one (1) snack, and one (1) non-alcoholic beverage per visit to a concessions market.
15. Refund Policy
There shall be no refunds, rainchecks, exchanges, or replacement of tickets except as provided for in the following Event Cancellation / Weather Policy.
Event Cancellation / Weather Policy
There shall be no refunds, rainchecks, exchanges, or replacement of tickets if at least three (3) cumulative hours of practice and/or play are held on the day specified on this ticket. If there are fewer than three (3) cumulative hours of practice and/or play on the day specified on this ticket due to an act of God or other matter beyond the control of the PGA, the PTC and the PGA reserve the right, in their sole discretion and subject to the further limitations in this paragraph, to provide ticket holders with one of the following: (i) a full refund of the purchase price of the ticket paid to the PGA, (ii) a partial refund of the purchase price of the ticket paid to the PGA, or (iii) the opportunity to attend a rescheduled event or exchange tickets for a comparable ticket to a different day in the Event.
Without otherwise limiting the foregoing, Holder acknowledges and agrees, if this ticket is a Ryder Cup+ Inclusive Food & Non-Alcoholic Beverage Program ticket, that $120 of the price of your ticket is allocated to food and non-alcoholic beverages services comprising the Ryder Cup+ Inclusive Food & Non-Alcoholic Beverage Program and you agree that if food and non-alcoholic beverage services comprising the Ryder Cup+ Inclusive Food & Non-Alcoholic Beverage Program are made available for at least three (3) cumulative hours on the day specified on the applicable ticket, regardless of how many hours of play take place on such day, then no refund will be provided for that food and non-alcoholic beverage portion of the ticket price. The price of your Ryder Cup+ Inclusive Food & Non-Alcoholic Beverage Program ticket allocated to food and non-alcoholic beverages is exclusive of 8.625% state and local sales tax.
16. PGA and PTC reserve the right to deny access to anyone who attempts to enter, or enters, the Event grounds with a ticket obtained through inappropriate or unlawful sources, including, but not limited to, through sources prohibited by this Agreement. PGA and PTC also reserve the right to seize the tickets. Violators are subject to removal from the premises and/or face criminal prosecution.
17. PGA and PTC reserve the right to provide your Event ticket in any form, including but not limited to print, e-mail, mobile, or any other mode of digital ticketing.
18. Event tickets may further be revoked without refund or other consideration and the holder of Event tickets may be removed from the Event for failure to comply with any term of this Agreement, failure to obey any and all posted signs at the Event, failure to obey instructions of the Event Marshals and Officials, and/or failure to adhere to Golf Mode guidelines or any other rules, guidelines, or codes of conduct established by the PGA or PTC in advance of, or at, the Event. PGA or PTC’s liability for breach of any term of this Agreement shall not exceed the face value of the Event ticket less the portion of the Event ticket price allocated to food and non-alcoholic beverages (as noted in Paragraph 15 above). IN NO EVENT SHALL PGA OR PTC BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF THE FACE VALUE OF THE TICKET LESS THE PORTION OF THE TICKET PRICE ALLOCATED TO FOOD AND NON-ALCOHOLIC BEVERAGES (AS NOTED IN PARAGRAPH 15 ABOVE). Patina’s liability for breach of any term of this Agreement shall not exceed the portion of the Ryder Cup+ Inclusive Food & Non-Alcoholic Beverage Program ticket price allocated to food and non-alcoholic beverages (as noted in Paragraph 15 above), if any. IN NO EVENT SHALL PATINA BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, INCIDENTAL, INDIRECT, OR EXEMPLARY DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, ANY AMOUNT PAID IN EXCESS OF THE PORTION OF THE RYDER CUP+ INCLUSIVE FOOD & NON-ALCOHOLIC BEVERAGE PROGRAM TICKET PRICE ALLOCATED TO FOOD AND NON-ALCOHOLIC BEVERAGES (AS NOTED IN PARAGRAPH 15 ABOVE), IF ANY.
19. Unsolicited and consistent calls from the gallery towards players are prohibited.
20. Holder shall not seek autographs of players during competition days (Friday, Saturday & Sunday).
21. Prohibited items include all backpacks, coolers, weapons of any kind (regardless of permit), bags larger than 10” x 10” x 10”, folding chair bags (chair must be removed from bag at security checkpoint), drones, signs, selfie sticks, whistles/noisemakers and other items deemed inappropriate or dangerous by Event security in their sole discretion. Prohibited bags will not be accepted or stored. Cameras allowed Tuesday and Wednesday only.
22. There will be no daily readmission to the grounds of the Event. Once a ticket has been scanned, it will no longer provide admission, except when the weather warning signs have been posted.
23. Should any portion or provision of this Agreement be held invalid, void, or otherwise unenforceable, the remaining provisions shall remain in full force and effect.
